GENERAL CONDITIONS OF SALE

Delivery and shipment: Goods are delivered ex-works; goods are always shipped at purchasor's risk even when carriage-free. For shipment by postal package, Samedil Srl assumes no responsibility for non-delivery or for mis-sing goods shipped in "unconditional packages". Samedil Srl assumes no responsibility for late delivery of goods on the part of forwarding agents and will not answer claims for direct or indirect damages for late delivery on its part of goods ordered.

Claims: All claims for missing goods or for discrepancies in invoices from the terms agreed must be received in writing within 8 days of the delivery of the goods or of the invoice. In the case of just claim, the purchasor shall be enti-tled only to the replacement of the goods or to be credited with the sum due; no other indemnity will be considered.

Warranty: Samedil tools are guaranteed against defects in materials and workmanship. No other guarantee is provided for or acknowledged. The responsibility of Samedil concerning claims under warranty is limited to the replacement of faulty goods and does not under any circumstances extend to any damages whether direct or indirect. Claims under warranty shall be con-sidered subject to immediate written notification of the fault and return of the goods to Samedil carriage paid. Warranty does not extend to tools which show normal wear and tear or to tools used or handled in a manner for which they were not designed. In no case does any warranty extend to tools which exceed 600 mm. in length.

Miscellaneous: The drawings and illustrations in this publication are for representational purposes only and are not to scale. We reserve the right to modify at any time product specifications or prices as a consequence of pro-duction requirements, quality improvements or increases in production costs.

Recommendations: We strongly recommend the use of safety equipment such as helmets, reinforced footwear, visors, eye-goggles, etc..

Competent jurisdiction: Any dispute shall fall under the competence of 'L'Autorità Giudiziara del Foro di Milano' (the Law Courts of Milan), except in the case that Samedil shall desire to proceed before a different Legal
